CIVIL “IN REM” FORFEITURE COMPLAINT
(Pursuant to K.S.A. 60-4113 (b))

I, Tony Cruz, the undersigned Assistant Geary Count Attorney, acting by authority granted me under the laws of the State of Kansas, hereby inform the court that:
1. On March 10, 2014, in Geary County, Kansas, the Junction City Police Department conducted a traffic stop on I-70 milepost 310, west bound. The reason for the traffic stop as advised by the officer was for three traffic violations. During contact, it was suspected that they may be involved in criminal activity. A K-9 was used for an exterior sniff with a positive alert to the odor of narcotics. A search revealed $24, 104.00 in U.S. Currency, 4 grams of Cocaine, 1 gram of Marijuana and Drug Paraphernalia. Both occupants were arrested and transported to the Geary County Detention Center. This investigation revealed that the vehicle was being used to facilitate the transportation and concealment of Marijuana, Cocaine, Drug Paraphernalia and the currency was believed to be derived from the Sale of Narcotics. On or about the 2nd day of April, 2014, a copy of “Notice of Pending Forfeiture” was delivered by certified mailing return receipt to Jason McConnell and Steven Clark. On the 10th day of April, 2014 a copy of the “Notice of Pending Forfeiture” was personally served on Edwin Capacetti-Negron in his cell at the Geary County Detention Center. Mr. McConnell mailed a copy of the Title, US Bank Transaction History, copy of a check from Jason McConnell to Luxury Sport Auto and a copy of a check from State Farm Mutual Automobile Insurance Company to Jason McConnell which was received in the plaintiff’s attorney’s office on the 27th day of May, 2014.
2. The Kansas Standard Asset Seizure and forfeiture Act (KSASFA) permits the plaintiff to contest this claim by filing a civil, in rem complaint. The State of Kansas hereby rejects the claims because: (a) the copies of the documents does not comply with K.S.A. 60-4111.

WHEREFORE the plaintiff requests an order which forfeits this defendant property to the Junction City police department for retention, interagency transfer, destruction, investigative use or training, or sale pursuant to K.S.A. 60-4117.
